Privacy Policy

Welcome to MyNovel.net ("Platform", "Service"). These Terms of Use ("Agreement") govern your access to and use of the Platform operated by Biblioteka ES Limited, a limited liability company registered under the laws of the Republic of Cyprus (Reg. No. HE381372), with its registered office at Emmanouil Roidi 6, 1095 Nicosia, Cyprus ("MyNovel", "we", "our", or "us").
By using the Platform, you ("User", "you") agree to be bound by this Agreement. If you do not agree, you must not use the Platform.
1. DEFINITIONS
- User: A natural person of legal age who registers and/or accesses the Platform for the purpose of reading digital literary content.
- Platform: The website www.mynovel.net and related mobile apps and tools owned and operated by MyNovel.
- Completed Work: A literary work marked as completed and made available for purchase or reading.
- Bookscription: Time-limited or progress-based access to a Work-in-Progress.
- Subscription: A paid plan granting Users time-based access to a catalogue of works.
- Commercial Work: Any Work available to the User in exchange for a fee.
- Price: The amount payable for access to a specific Work or Subscription, inclusive of applicable taxes.
- Content: All reviews, comments, and other user-generated material submitted to the Platform.
- Gift Card means a digital or electronic voucher purchased via the Platform, usable for digital content like e-books or audiobooks within its balance.
- Gift Card Balance means the remaining funds on a Gift Card after activation, usable for purchases until fully spent or expired.
- Gift Card Price means the total amount payable by the User for a Gift Card. This may include taxes or payment system fees based on the User’s location or payment method.
2. USER ACCOUNT
2.1 Users must be at least 18 years of age or have legal capacity under applicable law to enter into a binding contract.
2.2 To use the Platform, Users may be required to register an account and provide accurate and up-to-date information.
2.3 Users are responsible for maintaining the confidentiality of their login credentials. MyNovel shall not be liable for any unauthorized access resulting from failure to safeguard credentials.
3. END USER LICENSE AND ACCESS
3.1 Subject to compliance with this Agreement and payment of applicable fees, MyNovel grants Users a limited, non-exclusive, non-transferable, non-sublicensable right to access the Platform and the purchased Works.
3.2 No ownership rights or intellectual property rights are transferred to the User. Users must not copy, redistribute, or exploit Works in any unauthorized manner.
4. PAID CONTENT
4.1 Users may access Works by:
(a) purchasing a single Completed Work;
(b) purchasing access to a Work-in-Progress (Bookscription);
(c) subscribing to a time-based access plan (Subscription).
4.2 The risk that a Work-in-Progress may not be completed is accepted by the User. No refunds will be issued for incomplete or deleted Works accessed via Bookscription.
4.3 Users with active Subscriptions may access any eligible content designated within the plan during the subscription period. Content availability may vary over time.
4.4 All Prices are displayed in US dollars and include applicable VAT unless stated otherwise. Prices may vary depending on the payment provider and location.
4.5 MyNovel reserves the right to modify the Price of any product or Subscription at any time.
4.6 The User may view their purchases and invoices in the "Purchases" section of their account. MyNovel may also send an invoice via email after a purchase.
5. REFUNDS AND CANCELLATIONS
5.1 Purchases of digital content are non-refundable. If the User disputes a transaction, they must contact Platform within 5 days of the transaction date.
5.2 You may cancel your Subscription at any time, and access will remain available until the end of the billing cycle. No partial refunds will be issued for early termination.
6. CONTENT AND REVIEWS
6.1 Users may post comments or reviews on the Platform. By doing so, you grant MyNovel a non-exclusive, irrevocable, royalty-free license to use, display, and moderate your Content.
6.2 You agree not to post any Content that is unlawful, defamatory, misleading, offensive, or infringes third-party rights.
6.3 MyNovel reserves the right to remove or moderate Content at its sole discretion.
7. INTELLECTUAL PROPERTY
7.1 All intellectual property rights in the Platform, including but not limited to design, software, and Works, belong to MyNovel or its licensors.
7.2 Users are prohibited from reproducing, copying, scraping, modifying, or creating derivative works from any part of the Platform without prior written consent.
7.3 MyNovel, http://mynovel.net and all related logos included in or made available through the MyNovel are trademarks or registered trademarks of MyNovel in the European Union and other jurisdictions. MyNovel’s trademarks and trade dress may not be used in connection with any product or service that is not MyNovel’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits MyNovel. The User may not use any MyNovel’s logo or other proprietary graphic or trademark as part of a hyperlink without express written permission from MyNovel. All other trademarks not owned by MyNovel that appear in the Platform are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by MyNovel.
7.4 All intellectual property rights not expressly granted to the User in the Agreement or any applicable terms are reserved and retained by MyNovel or its licensors, suppliers, rightsholders, or other content providers. Neither the Platform nor any part of it may be reproduced, duplicated, copied, sold, resold or otherwise exploited for any purpose without express written consent of MyNovel. The User may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of MyNovel without express written consent. The User may not use any meta tags or any other “hidden text” making use of MyNovel’s name or trademarks without the express written consent of Booknet.
8. DATA PROTECTION
8.1 MyNovel processes personal data in accordance with its Privacy Policy and applicable EU and Cypriot data protection laws.

9. LIABILITY AND DISCLAIMERS
9.1 The Platform and content are provided on an "as is" and "as available" basis. MyNovel makes no warranty as to availability or error-free operation.
9.2 MyNovel is not responsible for the loss of access caused by third-party outages or force majeure.
9.3 To the extent permitted by law, MyNovel shall not be liable for indirect, incidental, or consequential damages. Our aggregate liability is limited to the amount paid by the User in the previous 12 months.
10. Gift Card Balances
10.1 General Provisions
10.1.1 Gift Cards are sold and issued by MyNovel.net.
10.1.2 Gift Cards are available for purchase in various denominations.
10.1.3 A Gift Card cannot be used to buy another Gift Card.
10.1.4 Gift Card balances cannot be withdrawn or transferred to other Users.
10.2 Activation and Usage
10.2.1 Activation occurs automatically upon purchase. The value is added to the User’s Gift Card balance.
10.2.2 Gift Card balances can be used to buy digital content (e-books, audiobooks, etc.) on the Platform.
10.3 Validity and Limitations
10.3.1 Once activated, the balance is valid as long as the User’s account is used at least once every three years.
10.3.2 If the balance is not used within three years, unused funds will be automatically deducted.
10.3.3 If the Gift Card balance remains unused for 12 months, a 5% monthly maintenance fee is deducted from the remaining balance.
10.3.4 Gift Cards may not be resold.
10.4 Loss, Fraud, and Security
10.4.1 The User is responsible for safeguarding their Gift Card.
10.4.2 MyNovel.net reserves the right to suspend or cancel a Gift Card balance in case of fraud.
10.5 Final Provisions
10.5.1 MyNovel.net may modify this policy at any time. Users will be notified of significant changes.
10.5.2 MyNovel.net is not liable for consequences resulting from the User’s failure to comply with these rules.
11. TERMINATION
11.1 Users may delete their account at any time. Deletion will not affect the rights acquired for content already purchased.
11.2 MyNovel may terminate or suspend access if the User breaches this Agreement or applicable law.
12. GOVERNING LAW AND DISPUTES
12.1 This Agreement shall be governed by the laws of the Republic of Cyprus.
12.2 Any disputes shall be resolved by the competent courts of Nicosia, Cyprus, unless mandatory consumer protection laws require otherwise.
13. MISCELLANEOUS
13.1 MyNovel may amend these Terms at any time by providing notice at least 30 days before changes take effect.
13.2 Continued use of the Platform after changes come into force constitutes acceptance of the updated Terms.
13.3 If any provision of this Agreement is deemed invalid, the remainder shall remain in full force.
13.4 Users may not assign their rights under this Agreement without MyNovel’s prior written consent.
